Welcome to ladygetz.com & courses.ladygetz.com. The Lady Getz website(s) (the “Site”) is comprised of various web pages & sites, operated by Lady Getz Fashion (101278973 SASKATCHEWAN LTD.). Ladygetz.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of ladygetz.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

ladygetz.com is a website offering products, PDF downloads, webinars, video trainings, online programs & podcast.

The online courses available through ladygetz.com (the “Courses”) are created and sold by Lady Getz Fashion . (“Lady Getz”, “us”, “we”, “our”), an affiliate of Lady Getz Fashion / 101278973 SASKATCHEWAN LTD. The Courses are available for purchase through the ladygetz.com.com website operated by us (the “Website”).

By purchasing a Lady Getz Course, you agree to comply with and be legally bound by the following terms (the "Course Terms"). In addition, you agree to comply with and be legally bound by the following general Terms and Conditions and Privacy Policy set out on the ladygetz.com websites, which are incorporated into these Course Terms and form part of your contract with Lady Getz Fashion.

Please read these Course Terms carefully before purchasing a Course from Lady Getz Fashion. If you purchase a Course, you will be deemed to have accepted these Course Terms.

Privacy

Certain information that we collect about you are subject to the Privacy Policy set out on the ladygetz.com's websites, the terms of which are incorporated into these Course Terms. The Privacy Policy applies to the personal information collected and retained directly by us.

Creation of a profile and use of the Courses will also be subject to the privacy policy of Kajabi, which is a third-party service provider. We do not control and are not responsible for the privacy practices and policies of Kajabi. Please read Kajabi’s privacy policy (https://kajabi.com/policies/privacy) prior to providing your personal information in connection with the creation of a profile or the purchase of a Course.

Electronic Communications

Visiting ladygetz.com or sending emails to Tia Getzlaf (owner of Lady Getz Fashion) constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account

If you use the site(s), you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Tia Getzlaf (Lady Getz Fashion) is not responsible for third party access to your account that results from theft or misappropriation of your account. Lady Getz Fashion and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Recurring Payments

If You have signed up for a payment plan, You hereby authorize Our continued access to Your financial information stored by Our third-party financial processing company referenced in this Agreement until Your payment plan is complete, as set forth in Your acceptance of the purchase terms upon checkout.

Usage of Courses

The Courses are intended for personal use only and may not be used for any commercial or other business purposes. As the purchaser, you are free to apply the tools and techniques learned in the Courses for the purpose of developing your personal, professional, or business brand; however, the Courses may not be used for any purpose that is intended to generate revenue directly for you or your business

Your purchase of a Course does not entitle you to modify, share, resell, redistribute, or copy the Courses in any form.

Children Under Thirteen

Tia Getzlaf (Lady Getz Fashion) does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use ladygetz.com only with permission of a parent or guardian.

Links to Third Party Sites/Third Party Services

From time to time, websites operated by our affiliates or related entities, including ladygetz.com & passionandpurposeradio.com, may include links to our Website. These links are included for convenience only. When you purchase a Course, you are entering into a contract with Lady Getz Fashion. You will have no relationship with any of our affiliates or related entities by reason of purchasing a Course and our affiliates or related entities will not be liable in any way, either directly or indirectly, for any loss or damage of any kind incurred as a result of, or in connection with, your purchase of a Course.

The Linked Sites are not under the control of Lady Getz Fashion and Tia Getzlaf is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Lady Getz Fashion is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Lady Getz Fashion of the site or any association with its operators.

Certain services made available via ladygetz.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the ladygetz.com domain, you hereby acknowledge and consent that Lady Getz Fashion may share such information and data with any third party with whom Lady Getz Fashion has a contractual relationship to provide the requested product, service or functionality on behalf of ladygetz.com users and customers.

No Unlawful or Prohibited Use/Intellectual Property

Lady Getz reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Lady Getz Fashion’s sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

International Users

The Service is controlled, operated and administered by Lady Getz Fashion. If you access the Service from a location outside of Canada, you are responsible for compliance with all local laws. You agree that you will not use the Lady Getz Fashion, Content accessed through ladygetz.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Jurisdiction

The laws of the Province of Saskatchewan, Canada and the federal laws of Canada applicable therein govern these Course Terms and any dispute of any sort that might arise between you and us. Except as otherwise provided herein, you agree that any claim, whether at law or equity, arising out of or related to the provision of services or materials by us, regardless of the date of accrual of such dispute, will be within the exclusive jurisdiction of the courts of Saskatchewan, Canada.

Cancellation and Refunds

Due to the digital nature of the Courses, we do not offer refunds or exchanges on any Course purchases made from Lady Getz Fashion and/or Passion & Purpose Communications.

Indemnification

You agree to indemnify, defend and hold harmless Lady Getz Fashion, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Lady Getz Fashion reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Lady Getz Fashion in asserting any available defenses.

Course Platform

The Courses are hosted and sold through an online course platform operated by Kajabi, LLC (“Kajabi”), a third-party service provider. In order to access the purchased Courses and certain features of the Website, you will need to register a profile on Kajabi. Creation of a profile and use of the Courses may be subject to the terms of use and privacy policy of Kajabi. We do not control and will not be responsible for the accuracy or reliability of any information, data, opinions, advice, or statements contained within the Kajabi platform.

Software Requirements

Our Courses do not include the software needed to view them. Before purchasing a Course, please make sure you have an appropriate version of a web browser to view the Course. While we expect that our Courses will be accessible through most web browsers, we do not make any representations or guarantees that the Courses will be accessible with a particular web browser.

Limited Liability

Your use of the Courses is at your own risk. In no event will Lady Getz Fashion, its legal affiliates, or any of their respective directors, officers, shareholders, employees, or agents, be liable for any losses or damages, financial or otherwise, including without limitation loss or damage arising from the loss of data, revenue, salary, profits, or reputation in connection with the use of our Courses. We take no responsibility for, and will not be liable for, any error or inaccuracies in our Courses. The limitations in this section apply notwithstanding the failure of the essential purpose of any limited remedy.

Lady Getz Fashion’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Lady Getz Fashion’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by LADY GETZ FASHION  with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and LADY GETZ FASHION  with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and LADY GETZ FASHION  with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Severability

The invalidity or unenforceability of any provision of these Course Terms will not affect the validity or enforceability of any other provision of these Course Terms and any such invalid or unenforceable provision will be deemed to be severable.

Waiver

No waiver of any breach of any provision of these Course Terms will constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver will be effective unless made in writing and signed by the waiving party.

Assignment

We have the right to assign these Course Terms in relation to a merger, acquisition, corporate reorganization, by operation of law or otherwise.

Changes to Website, Courses, or Fees

In connection with any purchase of Courses from our Website, we do not make any promise regarding the continuation of any current features or functionality or delivery of any future features or functionality. We have the right to change any of the features of the Courses. We also reserve the right to change any prices and initiate any new fees in connection with the Courses.

Storage and Backup of Files

You are responsible for the appropriate storage and backup of any purchased Course content, if applicable. We are not responsible for any lost files.

Changes to Terms

LADY GETZ FASHION  reserves the right, in its sole discretion, to change the Terms under which rebellenutrition.com is offered. The most current version of the Terms will supersede all previous versions. LADY GETZ FASHION  encourages you to periodically review the Terms to stay informed of our updates. We may, at any time, for any reason, and without notice, make changes to: (a) our Courses, or (b) these Course Terms. Unless explicitly stated otherwise, any such changes or any new features or functionality we implement will take effect when posted to the Website and will be subject to these Course Terms, as amended from time to time. By purchasing a Course, you will be deemed to have accepted and agreed to be bound by any such changes.
